Terms of Service

1. Acceptance of Terms
By accessing or using TenderRadar (“the Service”), operated by TenderRadar (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms. If you do not agree, you must not use the Service.
2. Description of Service
TenderRadar is a procurement intelligence platform that aggregates public tender notices from government portals across Europe, uses artificial intelligence to classify and match opportunities against user-defined company profiles, and delivers scored results with configurable alerts. The data we provide is sourced from publicly available government procurement portals. We do not guarantee exhaustive coverage of all published tenders.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. The Service is intended for business use by professionals involved in procurement, sales, or business development.
4. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@tenderradar.io if you suspect any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms or that show signs of unauthorized use.
5. Organization Accounts and Multi-Tenant Access
The Service supports multi-tenant organization accounts. An organization administrator who invites you to a tenant account may have the ability to manage your access, view your activity within that organization, and control data shared within the organization. Your use of an organization account is also subject to any policies that organization may impose.
6. Subscriptions and Billing
Paid plans are billed monthly or annually as selected at subscription. All prices are in Euros (€) and exclude applicable VAT or other taxes, which will be added where required by law.
Payment is processed securely by Stripe, Inc. We do not store your full credit card number on our servers. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.
You may cancel your subscription at any time through your account billing settings. Upon cancellation, you retain access until the end of the current billing period. No refunds are provided for partial billing periods. We may change pricing with 30 days' notice; continued use after the price change takes effect constitutes acceptance.
7. Free Trial
We may offer a free trial period. At the end of the trial, your account will either convert to a paid subscription (if you provided payment details) or be downgraded to a limited free tier. We will notify you before any charges are applied.
8. Acceptable Use
You agree not to:
- Systematically scrape, crawl, or use automated means to extract data from the Service beyond normal API or interface usage
- Interfere with or disrupt the operation of the platform or its infrastructure
- Impersonate another user, entity, or misrepresent your affiliation
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service for any unlawful purpose, including circumventing public procurement regulations
- Resell, sublicense, or redistribute the Service or its data without our written consent
- Upload malicious code, viruses, or any material that could damage the Service
We reserve the right to suspend or terminate access for violation of this section without prior notice.
9. AI-Generated Content and Matching
The Service uses artificial intelligence, including third-party large language models, to classify tenders, build company capability profiles, and generate match scores. AI outputs are provided on an informational basis and may contain inaccuracies.
AI matching scores, classifications, and summaries are advisory only. They should not be the sole basis for procurement decisions. You are responsible for independently verifying any tender information before acting upon it. We disclaim all liability arising from reliance on AI-generated content.
10. Intellectual Property
The Service, including its design, software, AI models, branding, and documentation, is owned by TenderRadar and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription.
Tender data aggregated from public government portals remains in the public domain. Your company profiles, configurations, and uploaded data remain your property. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.
11. Data and Privacy
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
12. Third-Party Services
The Service integrates with third-party providers including Supabase (authentication and database), Stripe (payment processing), and OpenAI (AI classification). Your use of these integrations is also subject to their respective terms of service. We are not responsible for the availability or conduct of third-party services.
13. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and unplanned outages may occur. We are not liable for any loss or damage resulting from service interruptions, including missed tender deadlines.
14. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the completeness, accuracy, reliability, or timeliness of tender data or AI-generated content.
15. Limitation of Liability
To the maximum extent permitted by applicable law, TenderRadar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: missed procurement opportunities, inaccurate matching results, loss of data, loss of profits, or business interruption.
Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.
16. Indemnification
You agree to indemnify and hold harmless TenderRadar and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
17. Termination
You may terminate your account at any time by contacting us at hello@tenderradar.io or through your account settings.
We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately. We will retain and delete your data in accordance with our Privacy Policy.
18. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, without prejudice to your rights under mandatory consumer protection laws of your country of residence.
19. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or through a prominent notice on the platform. Continued use of the Service after the updated Terms take effect constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service before they take effect.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
